Parihar & Co charged with murder

Srinagar: In occupied Kashmir, Seven policemen, including two senior officials, were charged with murder on Wednesday by the Special Investigating Team of Police probing the fake encounter killings, in the court of Chief Judicial Magistrate here which sent the accused to judicial custody till March 8 and committed the case to Principal and Session judge.
Amidst tight security, Superintendent of Police, Hans Raj Parihar, Dy SP Bahadur Ram, three personnel of their escort Manzoor Ahmad, Zahir Abbas and Bansi Lal, and constables Farooq Ahmad Padroo and Farooq Ahmad Gudoo were brought to the court in the afternoon.
Before hearing of the case, the SIT officials led by SP (South) Uttam Chand brought two big steel boxes inside the court adding to the curiosity of the lawyers present. A constable opened one of the boxes and picked up a pile of files, including the chargesheet and FIRs against the accused. Another box contained the arms and ammunition shown as recovery from the murdered carpenter Abdur Rahman Padder as evidence.
After going through the files, the judge ordered the SIT to produce the accused. Wearing a grey jacket, Parihar was first to enter the court. He was followed by Bahadur Ram and then rest of the accused except Farooq Padroo. Soon cops brought Padroo, who had draped himself in a blanket and kept him with other accused in the witness box.
“All of them hatched a conspiracy of murder, kidnapping and destruction of evidence. This is what you have stated in the
chargesheet,” the judge asked the SIT officials. “Yes sir,” an official replied.
The judge asked the accused to file the objections, if any, through their counsels. On this Parihar said, “Police is not allowing me to meet my counsel and relatives.”
“We have already passed orders in this regard. But if you are facing any problem I will issue fresh orders to let you consult your counsel,” the judge observed.
Lawyers present in the court offered to provide legal assistance to the accused. The judge while acknowledging the offer said, “It is legal and constitutional right of any accused to choose counsels of their choice.”
“Please let me stay in Kothi Bagh lock up,” pleaded Farooq Padroo. “No you can’t as chargesheet has been produced against you. You have to be in the Central Jail,” the Judge said.
A lawyer appeared on behalf of Farooq Padroo and demanded medical aid for him, which the court agreed.
The judge sent the accused to judicial custody till March 8 and committed the case to Principal and Session Court. He also ordered transfer of all documents and evidences relating to the case to the court.
SP Uttam Chand heading the SIT told Greater Kashmir that the chargesheet was produced against the accused in the killing of the carpenter.
“The accused are under judicial custody and it is up to the Central Jail authorities whether they allow them to meet them their counsels. We have no role in it,” he said.
Court of 2nd Additional Munsiff Ist Class had on February 17 sent Parihar and Bahadur Ram, who were arrested earlier this month, to 14-day judicial custody.
